Who should be appointed as a representative?
The representative shall be established in one of the Member States where data subjects whose personal data are processed in relation to the offering of goods or services to them, or whose behaviour are monitored.(Art. 27(3) GDPR)
The Representative shall be designated in writing and its identity and contact details shall be communicated to the data subjects (Art. 13(1) & 14(1)a)
Role of the GDPR Representative
The representative is mandated to be addressed in addition to, or instead of data controllers and processors not established in the EU by third parties, on all issues related to processing, for the purpose of ensuring compliance with the GDPR.
The representative performs its tasks according to the mandate received from the controller or processor, including cooperating with the competent supervisory authorities with regards to any action taken to ensure compliance with the GDPR (Recital 80).
